Terms of Service

1. About these terms

These terms govern your use of Taptivo — the mobile apps, web app and website operated from New Zealand (“Taptivo”, “we”, “us”). By creating an account or using Taptivo you agree to these terms and to our Privacy Policy. If you do not agree, do not use Taptivo.

Taptivo is a marketplace: food and drink are prepared and sold by independent vendors, and deliveries are made by independent runners. When you place an order, your purchase contract for the food is with the vendor; Taptivo provides the platform, payment processing and coordination.

2. Eligibility and accounts

  • You must be at least 16 years old to create an account.
  • You must be at least 18 to purchase alcohol (only from licensed vendors, where offered) and to act as a vendor or runner.
  • You are responsible for your account and for keeping your sign-in methods (email, Google or Apple) secure. One person per account; information you provide must be accurate.
  • An account can hold multiple roles (customer, vendor, runner). Vendor and runner roles require identity verification and our approval before going live, and we may decline or revoke approval at our discretion.
  • Identity verification is performed by Stripe Identity. You must complete it to activate roles, and you must not attempt verification with documents that are not your own.

3. Orders, prices and payment

  • Prices are set by vendors and shown in New Zealand dollars, inclusive of GST unless stated otherwise. Delivery (“Runner”) and collection (“Line Skip”) fees are shown before you pay.
  • Payment is taken at checkout through Stripe. By saving a card you authorise us to charge it for orders you place. Store credit in your wallet is applied before your card is charged.
  • An order is placed only once payment succeeds. Vendors may decline an order (for example, if an item has sold out); declined orders are refunded.
  • Order-related chat, live status and the delivery handover code are provided to coordinate fulfilment; please use them only for that purpose.

4. Cancellations and refunds

  • Before a vendor accepts your order, you can cancel it in the app. Any store credit you applied is returned to your wallet in full, and your card payment is refunded minus the payment processing fee that the payment provider does not return to us.
  • After a vendor accepts, preparation has started: you can still cancel, but the order is not refunded.
  • If something is wrong with your order — missing, incorrect or unsafe items — contact support through the app. We (or the vendor) may offer a partial or full refund, which is returned to your original payment method.
  • Nothing in this section limits your rights under the New Zealand Consumer Guarantees Act 1993 or Fair Trading Act 1986, which apply despite anything else in these terms.

5. Store credit

Store credit (for example, credit earned by completing setup tasks) is promotional. It has no cash value, cannot be transferred, sold or withdrawn, is applied automatically at checkout, and expires if your account is closed. We may change or end promotional credit programmes at any time; credit already in your wallet remains usable.

6. Vendors

  • Vendors are independent businesses, responsible for their menus, prices, food preparation, hygiene and compliance with all applicable laws — including the Food Act 2014 and, where alcohol is sold, the Sale and Supply of Alcohol Act 2012 and the associated licensing and age-verification duties.
  • Menu information and photos must accurately represent what is sold. Allergen questions from customers must be answered honestly.
  • Payouts of order proceeds (less Taptivo’s fees, as agreed with you when your vendor account is approved) are made to the bank account you provide.
  • We may suspend or remove a vendor for food-safety concerns, misrepresentation, repeated poor service or breach of these terms.

7. Runners

  • Runners are independent contractors, not employees of Taptivo. Runners must handle food hygienically, deliver promptly, complete the in-app handover, and comply with road and safety rules for their mode of transport.
  • Delivery fees payable to runners are shown per job; payment terms are as agreed when the runner account is approved.

8. Content and acceptable use

Taptivo includes content you and others create: profile photos, business profiles, menu photos, chat messages and ratings. You keep ownership of your content and grant us a licence to host and display it for operating the service. You agree not to:

  • post content that is illegal, offensive, harassing, deceptive, or infringes someone else’s rights;
  • use chat for anything other than coordinating orders and support;
  • submit fake orders, fake ratings, or manipulate the marketplace;
  • probe, overload or interfere with the service, scrape data, or access it other than through the apps we provide;
  • impersonate another person or use another person’s identity documents.

We review reported content and may remove content or restrict accounts that break these rules. To report abusive content or behaviour, contact support@taptivo.io or message support in the app; we aim to act on reports of objectionable content within 24 hours.

9. Third-party services

Payments, saved cards and identity verification are provided by Stripe under Stripe’s own terms. Sign-in may be provided by Google or Apple. Maps and address search are provided by Google. We are not responsible for third-party services, but we choose reputable providers and limit what they receive to what their function needs (see the Privacy Policy).

10. Availability and disclaimers

Events are live environments: menus change, items sell out, and connectivity at venues can be poor. The app keeps a local copy of recent data so browsing keeps working offline, but payments require a connection. Taptivo is provided “as is” and we do not guarantee uninterrupted or error-free operation. Estimated preparation and delivery times are estimates only.

11. Liability

Nothing in these terms excludes rights that cannot be excluded under New Zealand law, including the Consumer Guarantees Act 1993. Where you use Taptivo for business purposes (vendors and runners), the parties agree the Consumer Guarantees Act does not apply to that use. Otherwise, to the maximum extent permitted by law, our total liability arising out of the service in any 12-month period is limited to the greater of the amounts you paid to Taptivo in that period and NZ$100, and we are not liable for indirect or consequential loss.

12. Suspension, termination and deletion

You can stop using Taptivo at any time and delete your account in the app under Account → Delete account. We may suspend or terminate accounts that break these terms, create risk for other users, or are required to be closed by law. Transaction records are retained as described in the Privacy Policy.

13. App store terms

The apps are distributed through the Apple App Store and Google Play. These terms are between you and Taptivo — not with Apple Inc. or Google LLC, who have no obligation to provide support or maintenance for the app and are not responsible for addressing any claims relating to it (including product liability, regulatory or IP claims). To the extent required, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You represent that you are not in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

14. Changes and governing law

We may update these terms; material changes will be signalled in the app or by email before they take effect, and continued use after that means you accept them. These terms are governed by New Zealand law and any disputes are subject to the non-exclusive jurisdiction of the New Zealand courts.
